All visitors to the PlanetBids.com and BidsOnline (BOL) powered website (the "Site") agree to the following terms and conditions. By virtue of accessing the Site, you indicate your acknowledgement and acceptance of these terms and conditions. BOL reserves the right to revise these terms and conditions at anytime and users are deemed to be apprised of and bound by any changes to these terms and conditions by virtue of using the Site.

The trademarks and logos and service marks ("Marks") displayed on the Site are the property of BOL and/or other third parties. Users are prohibited from using any Marks without the permission of BOL or such third party that may own the Marks. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, and creating derivative works of, any data, information, and other content on or obtained as a result of use of the Site ("Content"), except for the downloading of files so indicated and printing of those files for purpose of off-line review. All Content of the Site is protected by copyright.

The Content is created and/or prepared by independent sources, subscribing and utilizing our services, but not affiliated with BOL and/or by BOL. The Content is for information purposes only and is not intended, nor should be construed, as advice, recommendation, or solicitation.

Neither BOL nor the independent sources guarantee that the Content is accurate, complete or timely. BOL does not guarantee the suitability or potential value of any of the Content and has no obligation to update or revise the Content and BOL does not make any representations or warranties with regard to the results obtained from use of the Content. BOL specifically disclaims any liability (whether based in contract, tort, strict liability or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the Site or use of the Content, even if BOL has been advised of the possibility of such damages, including liability associated with any viruses which may infect a user’s computer equipment or damage software.

BOL reserves the right to seek all remedies available at law and in equity for violations of the Terms and Conditions, including the right to block access from a particular Internet address to the Site.

BOL is not responsible for the Content available on any other Internet sites linked to the Site. Access to any other Internet Site is at the user’s own risk.

BOL does not guarantee continuous, uninterrupted access. Operation of the Site may be interfered with by numerous factors outside of our control.

Access to and use of password protected and/or secure areas of the Site is restricted to authorized users only. Unauthorized users/individuals attempting to access these areas of the Site may be subject to prosecution. Authorized users are expected to take reasonable care that unauthorized users not use their access at any time. Failure to do so may result in termination of a user’s access, at the sole discretion of BOL.

Use of and access to the Site and to the Content is subject to all applicable federal, state and local laws and regulations. Terms and conditions and use of the Site shall be governed by the laws of the State of California without reference to conflict of laws principles and user submits to the jurisdiction of the State of California with respect to any dispute relating to use of the Site or Content.

Confidentiality. PlanetBids will take reasonable measures not to disclose website communications or information about SCAG and its vendors, except to the extent that PlanetBids believes in good faith that such action is reasonably necessary to (a) comply with the law or the directives of courts or governmental agencies; (b) present evidence in court of competent jurisdiction or other tribunal in an action to enforce any provision of this agreement, (c) respond to claims of any third party; Notwithstanding the foregoing, all communications directed to PlanetBids via the website such as questions, comments, inquiries, shall be deemed to be not confidential, unless specifically agreed otherwise in advance by PlanetBids.
